session language keyboard login panel changes positions from boot to boot

The session language keyboard login panel where you select keyboard or desktop session from before boot [for lack of better terminology] changes positions from boot to boot. As the password box appears in Ubuntu 9.10 sometimes the panel that allows one to change session type appears at the top of the screen and 8-9 times out of 10 the system locks before it can finish boot.
